Bid Protest Weekly Celebrates One Year Anniversary
General Counsel, P.C. is pleased to announce that today marks the one year anniversary of the Bid Protest Weekly. Since the inaugural publication on December 8, 2009, the Bid Protest Weekly has grown from a small publication solely being sent to General Counsel, P.C. clients and contacts, to a national newsletter with close to 25,000 readers.
The Bid Protest Weekly is authored/edited by Bill Welch, the Chair of General Counsel, P.C.'s Government Contracts Practice Group. (Almost) every week, the Bid Protest Weekly provides: the protester name, link to the decision, the impacted agency, the disposition of the protest, relevant keywords, the General Counsel, P.C. Highlight, and a summary of the facts, law, and legal conclusions in the decision. We hope that the Bid Protest Weekly is a valuable tool for the government contracts community.
This week, we are also pleased to announce that we will be publishing the First Annual Bid Protest Weekly Keyword Database and General Counsel, P.C. Highlight Review. Both of these publications will be available, at no charge, on our website. Look for these publications before the end of the year.
Finally, we wanted to take this opportunity to highlight an important aspect of the bid protest process that is not reflected in the decisions we summarize every week -- agency corrective action. Specifically, when a contractor considers whether to file a bid protest (which should never be filed without seriously considering the legal and business implications), one important outcome may not be readily apparent by the contractor. Many bid protests are resolved by agency corrective action. This is a result that General Counsel, P.C. is seeing more and more with our clients. If the contractor, in good faith, highlights a procedural or substantative error made by an agency, the agency will sometimes reopen the competive bidding or reevaluate existing proposals. This is sometimes an excellent result for the contractor.
